    Dear Suffolk County Council,

    Please provide all documents and correspondence since 2010 regarding the idea(1) of a road(2) north(3) of Ipswich(4) which may or may not be related to the scrapped plan of the 1990s.

    1:- This may be a concept, suggestion, plan, proposal, or recommendation by either a government official, member of the public or local press.

    2:- The road may be a single carriageway, dual carriageway, motorway or combination, that might be officially known or unofficially referred to as a Northern Route, Northern Relief Route, Northern Bypass, North Road, Central Suffolk Road, or Road North of Ipswich.

    3:- Simply anywhere above the town of Ipswich

    4:- Ipswich is the county town of Suffolk where SCC's HQ is located.

    Examples may include:-
    - correspondence with other councils, central government or politicians
    - internal meetings, surveys or reports
    - any objections or recommendations from residents or community groups

    1-4. Following careful consideration, we regret to inform you that we are unable to

    disclose the information requested.

    The information you have requested is being withheld as it falls under the exceptions in

    regulations 12(4)(b) of the Environmental Information Regulations 2004.

    12(4)(b) – Manifestly unreasonable

    The first part of this exception is where the time required is clearly disproportionate to the

    importance of the issue at stake. The second part is where the time required is so

    substantial that it would significantly interfere with the normal conduct of the authority's

    activities or entails a significant diversion of resources from other functions.

    Where regulation 12(4)(b) is engaged, a public authority may only refuse to disclose the

    information requested if, in all the circumstances of the case, the public interest in

    maintaining the exception outweighs the public interest in disclosing the information

    (regulation 12(1)(a)).

    The public interest in maintaining the exception arises from the impact on the public

    authority in devoting the time required to comply with the request.

    The Information Commissioner (who monitors adherence with the EIR) has stated, in

    similar cases, that there is clearly a very strong public interest in a public authority being

    able to carry out its wider obligations fully and effectively and not to have significant

    resources diverted in order to comply with one or more requests for information.

    Factors in favour of disclosure:

    • Promoting transparency, accountability and participation in decision making;

    • Promoting transparency, accountability and participation in public debate; and

    • Promoting transparency, accountability in public spending.


    Factors in favour of withholding information:

    • Dealing with the request in its current form is not practical and would cause a

    • disproportionate amount of disruption;

    • Dealing with the request would also be an unreasonable diversion of resources;

    • An officer would need to go through several years’ worth of information to identify

    • whether any relevant information was held; and

    • Each individual record if found would need to be reviewed to establish whether it

    • fell within the remit of the request.


    Taking into account the cost of staff time needed to identify whether the information is

    held and to check all the files held are supplied we feel that it is not in the public interest

    (public spending) to comply with the request.

    We are writing to request an internal review of Suffolk County Council's handling of our FOI request 'Northern Bypass/Northern Route/Northern Relief Road/Road North of Ipswich'.

    We strongly disagree with your view that it doesn’t meet the “public interest” requirement in regards to public spending. The Northern Bypass (also referred to as Northern Relief Route or Northern Route) is a hot topic that many local people (and many regional people) are deeply interested in.

    We therefore request an Internal Review. The public interest test is met (see a brief overall below) – if you fail to fulfil your responsibilities under the Freedom of Information Act we will complain to the Information Commissioner.

    We ask you not to unduly refuse other FOI requests due to political motivation.

    Various groups and organisations are calling for a Northern Bypass to complete an Ipswich Orbital to boost the Greater Ipswich economy and to support housing and traffic reduction from town roads. These include Orwell Ahead ( http://www.orwellahead.co.uk ), Northern Bypass Ltd ( http://www.northernbypass.co.uk ) making this request, a community group on Streetlife ( https://www.streetlife.com/conversation/... ) and Archant’s Ipswich Star who is running a “campaign for a northern bypass”.

    Suffolk County Council has commissioned a report into a Northern Route with all local authorities – Ipswich Northern Routes study ( https://www.suffolk.gov.uk/assets/Roads-... ), Ben Gummer MP (directly elected representative of voters in Ipswich) is in favour of exploring a northern route after the Upper Orwell Crossing and David Ellesmere Council Leader (Ipswich Borough Council) has expressed a need for a northern relief route to support growth in housing.

    An October 2012 poll by Evening Star/Ipswich Star shows strong support for a Northern Bypass ( http://www.ipswichstar.co.uk/news/a14_re... ) this support has grown ever since in response to lack of infrastructure investment and Orwell Bridge closures.     Having now conducted a formal review of your request, I can confirm that

    has been requested to cover renders it manifestly unreasonable for the
    amount of time and diversion of the councils resources it would take to
    fulfil the request.
